Abstract

The purpose of this research is to carry out an exploration of the concepts of gender, gender violence, Feminicide from the legal approach and from a psychoanalytic perspective, taking into account concepts such as those of the subjective constitution, Mirror Stadium, Oedipus and enjoyment ; from these, it can be demonstrated that the differences between the feminine and the masculine are given from the subjective constitution of the subject, producing certain psychic consequences that will give rise to the subjective position with which the subjects will be represented along his life. From the analysis performed, it was concluded that there are many gaps and inconsistencies in the conception and typification of the crime of Feminicide, so that the legal position and feminist discourse have proved insufficient to explain and solve the problem of Feminicide; that gender violence goes beyond the hatred of one sex towards another and that aggressiveness is not a matter of gender but a constitutive part of the subject, so we must resort to other theories and tools such as psychoanalytic theory to explain and understand the Feminicide
